Faualo maintains party expulsion unlawful

The Minister of Police and Prisons Faualo Harry Schuster and the legal advisor for the five cabinet ministers removed from the Fa'atuatua i le Atua Samoa ua Tasi (FAST) Party said their expulsion was not lawful.

Speaking to Samoa Observer after the Parliament morning session on Wednesday, Faualo said they will not take legal action on their expulsion as they know that under the law they cannot be removed.

"We will not move away knowing that we haven't done anything wrong and it's illegal what La'auli (Leuatea Schmidt) and others had done," Faualo said.

Faualo was responding to what former Minister of Women, Community and Social Development, Mulipola Anarosa Molioo said in an interview with an overseas media that the six terminated members of the FAST party should go back to a by-election.

Faualo said if La'auli and the other FAST members who voted them out of the party want to take legal action, then that's their choice.

"We will not waste our money in taking the matter to court because it was them (La'auli and other members) who made the illegal decision so it's up to them what they want to do," Faualo said.

"We will not go back to a by-election because we are legally members of the Fa'atuatua i le Atua Samoa ua Tasi (FAST) party," he said.

Earlier this month Faualo wrote to the Chairman of FAST Party, La'auli Leuatea Polataivao Schmidt clarifying this issue as the legal advisor for Prime Minister Fiame and other cabinet ministers who were sacked from the party.

The letter said he acknowledged receipt of the letter dated 15 January 2025 in which La'auli attempted to terminate them as FAST party members. 

Faualo went on and said in this letter that they rejected the notice of termination as relayed in the letter as unlawful and unconstitutional.

Prime Minister Fiame Naomi Mata'afa, Deputy Prime Minister Tuala Tevaga Ponifasio and four other cabinet ministers including Faualo Harry Schuster, Olo Afoa Fiti Va'ai, Leatinu'u Wayne Fong and Toeolesulusulu Cedric Schuster were the six members of FAST that were terminated from the party on 13th January.
