Appeal by former L.T.C. president upheld
An appeal by the former Land and Titles Court (L.T.C.) president, which sought declaratory orders to receive his salary and benefits, pending a substantive hearing has been upheld by the Court of Appeal.
Former L.T.C. president, Letufuga Atilla Ropati had his appointment abruptly revoked when new amendments to the L.T.C. Act were endorsed by the Legislative Assembly late last year.
The amendments saw the Government appointing a new President, Lesatele Rapi Vaai under the Constitution Amendment 2020 leaving Letufuga without a job.
That move was challenged by Letufuga in the Supreme Court which later dismissed his application to seek relief and interim orders.
In its sitting at Mulinu'u Tuesday morning, the Court of Appeal granted the appeal by the former L.T.C. president to receive payment for nine months pending the substantive hearing.
Lawyers Fuimaono Sefo Ainuu and Faimalomatumua Mathew Lemisio represented Fepuleai.
