50 companies face deregistration
A total of 50 local companies are facing removal from the Samoa Companies Register for failing to file returns or simply not carrying business.
The companies have until 6 July to file an objection with the Registrar of Companies.
The number of pending deregistrations was announced by Acting Registrar of Companies of the Ministry of Commerce, Industry and Labour (M.C.I.L.), Fiu Jacinta Matulino in a notice.
The notice named 44 local companies that failed to file annual returns and 6 companies that are no longer carrying on business.
The notice warned the listed companies that they would be removed from the Samoa Register Companies, pursuant to section 124 and 260 (a) of the Companies Act 2001 (“the Act”), as they failed to file annual return or no longer carrying on business.
"Therefore, there is o other reason for the company to continue in existence," the notice reads.
"The following companies will be removed from the Registrar after twenty (20) working days from the date of notice, unless the Company satisfies the Registrar by notice in writing that it is still carrying on business or there is either reason for it to continue in existence.
"Any person, who wishes to object to the removal of these companies, must file his or her objection with the Registrar of Companies by the 6 of July, 2023."
Pursuant to section 266 of the Companies Act 2001, if a notice is given of an intention to remove a company from the Samoa register, any person may deliver to the Registrar, not later than the date specified in the notice, an objection to the removal on any 1 or more of the following grounds: (a) that the company is still carrying on business or there is other reason for it to continue in existence; (b) that the company is a party to legal proceedings; that the company is in receivership, or liquidation.

Transport Co Ltd, Soul of Samoa Enterprises Limited, Telecomp-tronics Ltd, Plaza healthcare services (Samoa) Ltd, Samoan Agriculture and Development corporation Pty Ltd, the Qualie Consulting Group Ltd, P&M Betham Company Ltd, N&C Bonus Ltd, Taro Pages Samoa Ltd, Sky Travel International Ltd, Sekia Electronics & Gifts Limited, Paramount Shipping Services Ltd, New Eden Environment consultants & product Ltd, United Hardware & Construction Ltd, South Pacific Aqua & Agriculture Development Group Ltd, System Samoa Ltd, Shenzhen Zhongsa International Fishing Industrial Development Co.
