Prisoner disputes summary of facts

A prisoner accused of attempting to sexually violate a Norwegian woman who was climbing the Mount Vaea trail in 2015 has disputed the Police summary of fact in his hearing.

Daniel Vailopa has pleaded guilty to the charges against him including the theft of a cell phone worth A$2,000 belonging to the woman. 

The victim was working in Samoa when the incident occurred after the convict escaped from Tafaigata Prison on the 2nd August 2015 where he made his way to Vailima and attempted to sexually assault the victim. 

But prior to sentencing, Vailopa has raised questions about the Police summary of facts.

The accused was supposed to have been sentenced last week.

The matter was called before Justice Tafaoimalo Leilani Tuala Warren.

Lawyer Alalatoa Rosella Papali’i is representing the accused  while Fuifui Ioane is representing the National Prosecution Office. 

According to Ms. Ioane, sentencing has been postponed to allow the lawyers to sort out the facts Vailopa is disputing. If they don’t reach a settlement, there is a possibility for witnesses to be called again.

A decision is expected in the new year.
