A lawsuit against Mynas Supermarket for allegedly violating planning laws has been adjourned for another two weeks.

The matter went before the Supreme Court yesterday, and was adjourned after counsel Tafailagi Peniamina, representing the Office of the Attorney General, asked the Court for a two-week adjournment.

“We respectfully seek for the first defendant to confirm and serve with the amended statements to their claim against the plaintiff and we respectfully seek for a two weeks adjournment to consider the statement and serve a response,” she said.

Presiding Justice Mata Tuatagaloa granted the application. 

Komisi and Sala Lupe Chan Mow, who live next to the new supermarket, are alleging that Mynas Supermarket and the Ministry of Natural Resources and Environment breached the Planning and Urban Management Agency (P.U.M.A.) law.  

Sala Josephine Stowers, the counsel representing Komisi and Sala Lupe Chan Mow, clarified earlier that they had initially sought the Court’s approval to file an injunction to stop the opening of the supermarket.

However, that application is moot and therefore the need to amend their claim. 

“We are suing them for something else and it has to do with numerous issues, they are not in compliance with P.U.M.A. laws and that is our claim,” she told this newspaper.
